These Terms of Use (“Terms”) are an agreement between you and Sugam Edutech Private Limited (“Sugam Digital”, “we”, “us”) for your use of the Khet Scan: Field Tools Android app and its related services (“the App”). By installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
1. Not a government app
Khet Scan is an independent product. It is not affiliated with, endorsed by, or operated by the Government of Uttar Pradesh, the Government of India, NIC, the Revenue Department or any other government body. Names of government portals are used only to describe what the App connects to.
Information shown in the App comes from public government portals or from you. The official portal and official certified copies are the authoritative source. A record viewed in the App is not a certified copy and must not be presented as one. Always confirm important information with the relevant office before relying on it.
2. Who can use the App
You must be at least 18 years old and able to enter into a binding contract. The survey tools are meant for revenue field staff, such as lekhpals, who have their own valid login for the relevant government portal.
3. Free features and accounts
Most of the App — land-record lookups, court-case search, maps, measurement, GPS camera, scanning, PDFs, notes and reminders — is free and needs no account. The survey tools, Khet Scan Pro and Backup require Google sign-in. You are responsible for activity under your account and on your phone, and for keeping your phone and Google account secure.
Free daily limits. Some free tools have a daily limit on how many times they can be used (for example, reports opened or photos saved per day). When you reach a limit, you can take a short break of about one minute to unlock more uses, or subscribe to Khet Scan Pro. Limits reset each day (Indian time), are a little lower without sign-in, and count only successful uses. We may change the limits and which tools have them. Opening the official government portal pages in the App is never limited.
Pro-only tools. Some tools are part of Khet Scan Pro, currently: adding a signature to a PDF, merging, splitting and organising PDF pages, and the GPS-camera extras (video, stamp styles, stamping an existing photo and choosing a location on the map). Viewing and importing PDFs, saving photos or reports as PDF, converting PDF pages to images and compressing PDFs stay free, and any file you already made with a tool keeps opening.
4. The survey tools
The survey tools help you complete your own work on government portals (for example, filling and locking eKhasra crop-survey entries in bulk, and approving pending AgriStack images). By using them you agree that:
- you sign in to the government portal yourself, with your own credentials, and the App acts only within your portal session and on your instructions;
- you are authorised to perform the work, and you remain fully responsible for every entry filled, locked, approved or submitted from your login, as if you had done it by hand;
- you will review the selections and results before and after a run, and follow any rules, instructions or limits set by your department or the portal owner;
- entries locked or approved on a government portal may not be reversible through the App; and
- you will not use the survey tools on behalf of someone else’s login, or to make entries you know or suspect to be false.
5. Trial and season passes
- Each new account gets a one-time free trial of the survey tools, limited in time and number of plots as shown in the App. One trial per Google account; we may refuse or withdraw trials that appear to be claimed repeatedly.
- After the trial, locking survey entries and approving AgriStack images need an active season pass. Passes are time-based (for example weekly or monthly); while a pass is active you can use the survey tools for any of your halkas.
- Passes are bought in the App through Google Play (subject to Google Play’s terms), or on our website at sugamdigital.com/buy through Razorpay. Prices, durations and what is included are shown before you buy. A pass bought on the website is added to the Khet Scan account of the Google account you signed in with. Passes are prepaid and do not renew automatically; buying another pass while one is active adds its time after the current one.
- A pass is for one lekhpal: it is tied to one eKhasra employee code, which can be changed once per pass period. A fair-use limit (currently 1,200 plots per employee code per day) applies to prevent abuse.
- Refunds follow our refund and cancellation policy; for Google Play purchases, Google Play’s refund policies also apply. A refunded or reversed purchase removes the access it granted.
- We may offer promo codes on our website. Each code has its own conditions (for example which passes it applies to, when it is valid and how many times it can be used), is applied only at checkout, and cannot be exchanged for cash or combined with other codes. We may withdraw a code at any time; this does not affect a pass already bought with it.
- Passes and trial time have no cash value, cannot be transferred or exchanged, and are forfeited if your account is deleted or terminated for breach of these Terms.
- Khet Scan Pro members can buy season passes at a lower member price in the App while their Pro is active.
- We may change prices and plans for future purchases. Changes do not affect a pass you have already paid for.
5A. Khet Scan Pro
- What it includes: Backup of your work to your Khet Scan account with restore on a new phone (25 GB, see section 5B), no daily limits on the App’s tools (subject to fair use, below), the Pro-only tools listed in section 3, and lower member prices for survey season passes. We describe only features that exist in the App today; future features may be offered separately.
- Prices: ₹149 a month or ₹1,199 a year. For the first 60 days after Khet Scan Pro launches, a founder plan is also offered at ₹999 a year; its price does not increase for as long as that subscription keeps renewing without a break. Prices shown in the App or at checkout (including taxes as applicable) are the ones that apply.
- In the App (Google Play): Pro is a subscription that renews automatically at the end of each month or year until you cancel it in Google Play (Play Store → Payments & subscriptions → Subscriptions). Uninstalling the App or deleting your account does not cancel it. After you cancel, Pro stays active until the end of the period already paid. New subscribers may get a 7-day free trial on the monthly plan; if you cancel before the trial ends you are not charged. Google Play’s terms apply to payments, renewals, grace periods and refunds. If a renewal payment fails, Google Play may keep Pro active for a short grace period or put the subscription on hold; while on hold or paused, Pro features are off.
- On our website (Razorpay): Pro is a one-time prepaid payment for 30 days or 365 days. It does not renew automatically. Buying more while Pro is active adds the time after the current period. If you also have a Google Play subscription, both keep running; Pro time is not added together but you have Pro until the later of the two ends.
- Fair use: “no daily limits” is subject to fair use, to protect government portals and our services. We may slow down or pause unusually heavy automated use (currently above about 200 Instant reports a day) and will tell you in the App when this happens.
- Price changes: we may change Pro prices for new purchases. For an existing Google Play subscription, a price change happens only as Google Play allows, with notice, and never for founder subscriptions while they keep renewing.
- Pro is personal to your account and cannot be transferred. Refunds follow our refund and cancellation policy.
5B. Backup
- What it does: while you have Khet Scan Pro and Backup is turned on, the App copies your work files and their files (photos, videos, scans, PDFs and imports), notes, diary, reminders, measurements, field visits and your portal search history to your Khet Scan account, and lets you restore them on a new phone. Our Privacy Policy lists exactly what is included. Work files you mark “only this phone” are not uploaded.
- Storage: up to 25 GB per Pro account. When it is full, new files stay on your phone and are not backed up until you free space.
- One active phone: one phone at a time is your backup device. You can move the backup to another phone; to prevent misuse, moves are limited to about three in 30 days unless you contact support. A phone that is no longer the backup device keeps its local files but stops updating the backup.
- Encryption: backup data is encrypted in transit and while stored on our servers, with keys managed by us and our hosting provider. It is not end-to-end encrypted.
- When Pro ends: for example after you cancel and the paid period ends, a refund, or a Google Play subscription that expires. Your backup becomes read-only for 30 days: nothing new is uploaded, but you can still restore or download everything in the App. We email you when this starts and 7 days and 1 day before the end. After the 30 days, the cloud copy is permanently deleted. If you renew before then, nothing is deleted. While a Google Play subscription is on hold or paused, the backup is read-only but the 30 days start only when the subscription expires. Files on your phone are never deleted by this.
- Deleting your account also deletes your backup permanently.
- Other people’s data: your backup can contain personal data of other people (for example landowner names and records, case parties and documents). You confirm that you are allowed to keep this material for your work, and you remain responsible for how you use it. We store it only to provide Backup to you.
- Not a guarantee: we work to keep backups safe and complete, and the App shows which files are backed up. Backup can still fail (for example with no internet, a full storage quota, or a file removed before it was uploaded). Keep important originals and official copies, and check a file shows as backed up before you rely on it. Our liability is limited as set out in section 12.
6. Government portals and availability
The App depends on government portals that we do not control. They may change, slow down, go offline, return incomplete or incorrect data, or restrict access at any time, and features of the App may stop working as a result. We may change, pause or switch off any feature — including portal features, without notice, to keep the App working correctly. We do not guarantee that any portal will be available or that any task will finish.
If a paid survey feature is unavailable for an extended period because of a fault on our side, contact us and we will consider extending your pass.
7. Acceptable use
You agree not to:
- use the App unlawfully, or in breach of the terms or rules of a government portal or your employer;
- overload, disrupt, probe or attack any government portal or our services, or run the App in a way that sends unreasonable volumes of requests;
- access records or accounts you are not authorised to access;
- copy, modify, reverse-engineer, resell or redistribute the App, or create accounts or devices to get around trials, limits or payments; or
- use the App to collect, publish or misuse other people’s personal information.
We may suspend or close accounts that break these Terms or put users, portals or our services at risk.
8. Your content
Photos, videos, scans, measurements, notes and other files you create belong to you. They are stored on your phone and, if you use Backup, also in your Khet Scan account. You give us permission to store, copy, process and transmit them only as needed to provide Backup and restore to you. You are responsible for keeping copies. Except for what Backup holds under section 5B, we are not responsible for loss of local data, including when you uninstall the App, clear its data or change phones. You are responsible for having the right to capture and store any material, including material relating to other people.
9. Measurements, calculations and maps
GPS measurements, area and unit conversions, partition calculations and map overlays are estimates. Their accuracy depends on your device, GPS signal, satellite imagery and how the tool is used. They are for field reference only and are not a substitute for an official survey, demarcation (paimaish) or measurement by the competent authority.
10. Intellectual property
The App, its design, code and branding belong to Sugam Edutech Private Limited or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on your devices under these Terms. Government data remains the property of its respective owners. Third-party services such as Google Maps are subject to their own terms.
11. Disclaimers
The App is provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness, fitness for a particular purpose and uninterrupted operation. We are not responsible for decisions, entries or actions taken on the basis of information shown in or produced by the App.
12. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, records, income or reputation, arising from your use of the App or any government portal. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the three months before the claim, or ₹1,000, whichever is higher. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnity
You agree to compensate us for claims, losses and costs arising from your breach of these Terms, your misuse of the App, or entries made from your portal login.
14. Ending use
You may stop using the App at any time and delete your account from Survey → Settings or as described on our account deletion page. Deleting your account deletes your Backup and forfeits any unused Pro time; it does not cancel a Google Play subscription, which you should cancel in Google Play first. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue the App or a feature. Sections that by their nature should survive termination will survive.
15. Changes to these Terms
We may update these Terms. We will post the new version here with a new “Last updated” date and, for material changes, tell you in the App. Continuing to use the App after a change means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of India. Please contact us first so we can try to resolve any issue. Subject to that, the courts at Bareilly, Uttar Pradesh have exclusive jurisdiction.
